Underinsured Motorist Insurance CoverageGraham Lundberg & Peschel has long fought for the fair application of Washington's insurance laws for the benefit of injured people. Under Washington law, uninsured/underinsured motorist insurance protection is not mandatory. However, such coverage must be offered by an insurance company, and if an a person purchasing insurance declines such coverage, he or she must sign a written rejection of such coverage. If no such offer is made, and no written rejection obtained, then coverage must be retroactively applied. Underinsured motorist coverage may be available under a personal automobile policy, or under a commercial automobile policy for work related vehicles.
GLP has successfully argued that a self-employed ice cream truck driver should have been offered underinsured motorist insurance when he entered into a rental agreement with the owner of the ice cream truck, allowing the injured worker to make an underinsured motorist claim to recover from his injuries.
